Veseli d.o.o. turistička agencija (daljnjem tekstu Tvrtka) specijalizirana je za posredovanje usluga turističkog smještaja, prijevoz putnika, turističke transfere, organizaciju i provedbu izleta i paket aranžmana trajanja kraćeg od 24 sata koji ne sadržavaju usluge smještaja.. Posredovanje usluga turističkog smještaja Tvrtka uređuje separatnim ugovorima sa svakim pojedinim pružateljem usluga te taj segment naše ponude nije obuhvaćen ovim uvjetima poslovanja.

Tvrtka ima u vlasništvu dva vozila, Mercedes Vito 111 registarske oznake ST 8689H registriran za prijevoz do 8 osobe i Toyota C-HR Hybrid registarske oznake ST 5619R za prijevoz do 4 osobe. Za obavljanje poslova iz svoje djelatnosti Tvrtka posjeduje licenciju za unutarnji javni cestovni prijevoz, licenciju za autotaxi prijevoz, a u skladu s propisima dio svojih aktivnosti realizira i kao prijevoz za vlastite potrebe. Iznimno, u trenutcima visoke potražnje, Tvrtka dio aktivnosti realizira angažiranjem vozila partnerskih tvrtki s kojima ima regulirane poslovne odnose i ugodnu prethodnu suradnju.

TURISTIČKI TRANSFERI I PRIJEVOZ PUTNIKA

Prijevoz putnika i turistički transferi obavljaju se temeljem standardiziranih ugovora čije sklapanje prethodi realizaciji, kao autotaxi prijevoz ili kao prijevoz za vlastite potrebe.

Plaćanje usluga prijevoza i turističkih transfera u pravilu se obavlja gotovinom po obavljenom poslu. Iznimno plaćanje je moguće i novčanom transakcijom na poslovni račun Tvrtke. Plaćanja kreditnim karticama nisu moguća.

Posebnu pažnju posvetit će Tvrtka i putnici dogovaranju turističkih transfera koji završavaju u zračnim lukama kako bi osigurali dovoljno vremena za sigurni dolazak u zračnu luke najmanje 2,0 sata prije planiranog leta. Tvrtka neće snositi odgovornost za kašnjenja u dolasku na odredišta u prijevozima i turističkim transferima koji se realiziraju na inzistiranje putnika iako prethodno nije međusobno usuglašeno vrijeme ukrcaja.

Za vrijeme trajanja  usluga prijevoza i turističkih transfera svi putnici osigurani su od posljedica nesretnog slučaja.

IZLETI

Na svom mrežnom središtu ili na internetskim platformama koje se bave oglašavanjem izleta Tvrtka će za svaki izlet koji organizira istaknuti odredište, cijenu, plan putovanja, te broj i sadržaj obroka. Izleti se obavljaju osobnim vozilima u vlasništvu Tvrtke. Iznimno tvrtka može povjeriti realizaciju izleta partnerskim tvrtkama o čemu će pravovremeno informirati korisnike.

Rezervacije izleta vrše se isključivo kroz pismenu ili usmenu korespondenciju između Tvrtke i putnika putem e-maila ili mobilnih aplikacija. Po okončanoj korespondenciji  Tvrtka će putnicima dostaviti Vaučer kao konačnu potvrdu rezervacije. Za rezervacije izleta nije potrebno plaćanje predujma.

U slučaju vremenskih nepogoda Tvrtka će u dogovoru s putnicima, prije polaska ili u toku izleta, vršiti korekcije plana putovanja, nastojeći pružiti im najveći mogući doživljaj i najbolje iskustvo vodeći računa da se ukupni troškovi izleta i njegovo trajanje zadrže u očekivanjim okvirima. Putnici mogu u svakom trenutku otkazati izlet. U slučaju otkaza izleta koji je već započeo putnici plaćaju 70% ugovorene vrijednosti.                   Tvtka će u toku putovanja omogućiti putnicima sporazumne izmjene plana putovanja uz dogovoreno povećanje ukupne cijene srazmjerno povećanju ukupnih troškova putovanja.

Izdavanje računa i naplata izleta vrše se u pravilu u gotovini po završenom izletu. Iznimno moguća su i plaćanja novčanim transakcijama na poslovni račun Tvrtke. Plaćanje kreditnim karticama nije moguće

Realizaciji izleta prethodi potpisivanje standardiziranog ugovora u kojega se unose osobni podaci putnika, naziv izleta, cijena i način plaćanja. Plan putovanja sastavni je dio ugovora. Za trajanja izleta svi putnici osigurani su od posljedica nesretnog slučaja.

Putnici su odgovorni za odabir izleta koji odgovora njihovim interesima i sposobnostima. Za sva pitanja i/ili nesigurnosti stojimo na raspolaganju. Svi putnici su odgovorni za vlastite postupke. Agencija nije odgovorna za izgubljenu, oštećenu ili ukradenu prtljagu ili osobne stvari tijekom izleta. Putnici moraju biti punoljetni. Maloljetne osobe i djece mogu sudjelovati u izletu samo u prisustvu roditelja/skrbnika.

Taylor made izleti, izleti koji se organiziraju s više vozila I izleti organizirani za više od 8 putnika ugovaraju se izvan forme standardiziranih ugovora I mogu sadržavati odredbe različite od odredbi ovih uvjeta.

PAKET ARANŽMANI

Tvrtka organizira i provodi paket aranžmane čije trajanje nije duže od 24 sata i koji ne uključuju uslugu noćenja. U pravilu radi se o turističkim transferima koji se sastoje od cestovnog prijevoza na kopnu i prijevoza morem, a može sadržavati i cestovni prijevoz na otoku. Na ove paket aranžmane ne primjenjuje se Direktiva (EU) 2015/2302.

Cestovni prijevoz na kopnu obavljaju se osobnim vozilima u vlasništvu Tvrtke. Iznimno tvrtka može povjeriti realizaciju partnerskim tvrtkama o čemu će pravovremeno informirati korisnike.

Prijevoz morem obavlja se posredovanjem usluga prijevoza tvrtki koje pružaju usluge prijevoza morem, i to trajektima, katamaranima ili speedboatima. Za realizaciju ovog dijela aranžmana Tvrtka će korisnicima pribaviti putne karte za trajekt ili katamaran, odnosno posredovati u ugovaranju usluge prijevoza speedboatom s pružateljem usluge. Tvrtka će za pružatelja usluga speedboata odabrati partnersku tvrtku pažnjom dobrog gospodarstvenika.  Tvrtka ne preuzima odgovornost za izvršenje dijela paket aranžmana koji se sastoji od prijevoza morem. Za taj dio paket aranžmana punu odgovornost (naročito u pitanjima poštovanja reda plovidbe odnosno vremena polaska, trajanju prijevoza i sigurnosti putnika, osiguranja od posljedica nesretnog slučaja, odgovornosti za krađu, gubitak ili oštećene prtljage) preuzimaju tvrtke koje prijevoz obavljaju.

Prijevoz speedbotom specifična je vrsta prijevoza koji u bitnom ovisi o vremenskim prilikama. Konačnu potvrdu provedbe paket aranžmana koji sadrži i prijevoz morem speedboatom Tvrtka će putnicima dati u večernjim satima dan uoči dana u kojem je prijevoz dogovoren. U slučaju otkaza prijevoza zbog vremenskih prilika Tvrtka će u dogovoru s putnicima osigurati zamjenski prijevoz morem katamaranom  ili trajektom uz izmjenu dogovorene cijene.

Cestovni prijevoz putnika na otocima obavlja se vozilima partnera Tvrtke.

Ukupnu paušalnu cijenu paket aranžmana naplatit će Tvrtka po okončanom cestovnom prijevozu na kopnu.

Posebnu pažnju posvetit će Tvrtka i putnici dogovaranju paket aranžmana koji završavaju u zračnim lukama kako bi osigurali dovoljno vremena za sigurni dolazak u zračnu luke najmanje 2,0 sata prije planiranog leta. Tvrtka neće snositi odgovornost za kašnjenja koja su posljedica poremećaja u prijevozu morem bez obzira na uzrok. Tvrtka neće snositi odgovornost za kašnjenja u  paket aranžmanima koji se realiziraju na inzistiranje putnika iako nije međusobno usuglašen početak i faze trajanja transfera.

OSOBNI PODACI I POLITIKA PRIVATNOSTI

Osobne podatke dobivene od putnika (ime, prezime, adresa, e mail adresa i ostale) Tvrtka neće davati na uvid drugim osobama ili tvrtkama. Putnik je suglasan da Tvrtka koristi njegovu e-mail adresu za slanje informativnih i marketinških materijala. Tvrtka se obvezuje, na zahtjev putnika odmah ukloniti njegove podatke iz newsletter liste.

PRIGOVORI

U slučaju prigovora na nepotpuno ili neuredno izvršene usluge putnik je dužan prigovor bez odlaganja uputiti predstavniku davatelja usluge na licu mjesta. Tvrtka je dužna, ako je moguće, nedostatke ukloniti na licu mjesta.

Ako Tvrtka nije uklonila nedostatke, putnik može u roku od 8 dana od završetka putovanja uputiti pismeni prigovor Tvrtci. Tvrtka neće uvažiti prigovor upućen nakon proteka roka od 8 dana od trenutka okončanja usluge, kao ni onaj koji je putnik propustio uputiti bez odlaganja na licu mjesta, te je Tvrtci uskratio mogućnost da otkloni razloge prigovora.

Upute za podnošenje pisanog prigovora istaknute su na mrežnim stranicama tvrtke.

ZAVRŠNE ODREDBE

Ovi Opći uvjeti sastavni su dio Ugovora kojeg putnik sklapa s Tvrtkom. Isti će biti istaknuti na mrežnim stranicama Tvrtke i dostavljeni e-mailom kojim Tvrtka konačno potvrđuje rezervaciju pojedine usluge. Trenutkom početka realizacije pojedine usluge smatra se da su putnici prihvatili ove Opće uvjete.

MJERODAVNO PRAVO I NADLEŽNOST SUDA

Na ugovorni odnos između Organizatora i Putnika primjenjuje se pravo Republike Hrvatske. Za slučaj spora nadležan je stvarno nadležni sud u Splitu.

Veseli d.o.o. turistička agencija (hereinafter „the Company“) is specialized for brokerage of tourist accommodation services, passengers transportation,  tourist transfers,  organization and making of trips and the package travels shorter than 24 hours and not comprising accommodation services. The Company arranges the brokerage of tourist accommodation services by separate contracts with each individual service provider, so that part of our offer is not included in these General Business Conditions.

The Company owns two vehicles, Mercedes Vito 111, registration number ST 8689H, registered for the transportation up to 8 passengers, and Toyota C-HR Hybrid, registration number ST 5619R, for the transportation up to 4 passengers. For performing the services within its activity range, The Company possesses the internal public route transport license, the car taxi transport license, and, according to regulations, The Company performs part of its activities as own-account transportation. Exceptionally, in times of great demand, the Company realizes a part of its activities by engaging vehicles from the partner companies, with which it has well regulated business relations and a history of good cooperation.

TOURIST TRANSFERS and PASSENGERS TRANSPORTATION

Passengers transportation and tourist transfers are performed through standardized contracts which are signed prior to realization, as car taxi transport or own-account transportation.

The payment of transport services and tourist transfers is as a rule made in cash upon the realization of services. Exceptionally, the payment may be made by a money transaction on the business account of the Company. The payments by credit cards are not accepted.

The Company will pay a special attention to agree with passengers the tourist transfers  to airports, in order to insure enough time for the safe and timely arrival to airports, at least 2,0 hours prior to the flight. The Company will not be responsible for any late arrivals to destinations in passenger transports and tourist transfers which are realized at the insistence of passengers although  the pick-up time is not mutually agreed in advance.

All the time during transportation and tourist transfers all the passengers are insured from the consequences of accidents.

EXCURSIONS

On its webpage, or on internet platforms advertising tourist excursions,  the Company will specify for each offered excursion the destination, the price, the journey plan and the number and content of meals. The excursions are performed by the vehicles  in the Company ownership.

Exceptionally, the Company may entrust the excursion realization to partner companies, in which case clients will be timely informed by the  Company.

Excursions reservations are done exclusively through written or oral communication between the Company and passengers by e-mail or mobile applications. Upon final agreement the Company will send to passengers a Voucher as the final confirmation of reservation. The advance payment is not necessary for excursion reservations.

In case of bad weather conditions, the Company will, in agreement with passengers, before the journey or during the journey, make necessary changes of the journey plan, trying to offer the best experience under the given weather conditions,  while keeping the costs and the duration of the excursion within the previously agreed limits. Passengers may cancel the excursion at any moment. In case of cancelling the excursion that is going on, passengers are to pay 75% of the agreed amount. The company will, in the course of the journey, make possible to the passengers to change the planned journey, agreeing  with the Company about the changes as well as about the increase of the previously agreed prices according to the increase of total journey costs.

The bill issuing and payment are made, as a rule, in cash upon the finishing of the excursion. Exceptionally, it is possible to make the payment by a transaction on the Company’s business account. Credit cards payments are not possible.

Prior to the beginning of the excursion, a standardized contract will be signed. It includes  passengers’ personal data, the excursion name, the price and the way of payment. The plan of journey is the basic contract part. During the excursion all passengers are insured  against accident consequences.

Passengers are responsible for choosing the excursion that suits their interests and capabilities. We are on your disposal for all questions and doubts. All passengers are responsible for their own behavior. The Company is not responsible for lost, damaged or stolen luggage or personal belongings during the excursion. The passengers must be major of age.  Minors and children can take part in the excursion only in the presence of parents/guardians.

PACKAGE TRAVELS

The Company organizes and makes package travels whose duration is not longer than 24 hours and which do not include the service of  overnight stay.  As a rule, package travels are tourist transfers including route trasportation on land and sea transportation, and may include route transportation on islands.  The Directive (EU) 2015/2302 is applied to such package travels.

      Route transport on land is performed by the vehicles  in the Company ownership. Exceptionally, the Company may entrust the realization to partner companies, in which case clients will be timely informed by the Company.

The sea transportation is done by the brokerage with companies specialized for sea transportation services by ferries, catamarans and speedboats. For the realization of this part of the arrangement the Company will provide to clients the ferry or catamaran tickets, or mediate in contracting the speedboat sea transportation services  with the service provider. The company will choose the speedboat service supplier with  best efforts guarantee. The company does not take responsability for the realization of the part of the package travel which includes the sea transport by speedboat.  For that part of the package travel, the full responsibility is taken by the companies that perfom the sea transportation (especially as concerns the schedule, i.e. the departure time, the journey duration time, the safety of passengers, the insurance against accidents, responsibility for theft, losing or damaging of luggage).

The speedboat transportation is a specific sort of transportation that depends to a great extent on weather conditions.  The final confirmation of the package travel  including a speedboat sea transportation will be given to passangers in the evening hours of the day preceding the arranged transportation.  In case of cancelling of the transportation due to weather conditions, the Company will, in agreement with passangers, insure the replacement sea transportation by catamaran or by ferry, with the necessary changes of the agreed price.

Route transportation on islands is made by the Company partners’ vehicles.

The total package travel flat-rate price will be paid to the Company, upon the finishing of the route transportation on land.

The Company and the passangers will pay special attention to the agreements of package travels which finish in airports, so as to insure enough time for a safe arrival to airports at least 2,0 hours before the planned flight. The Company will not take any responsability for being late as a consequence of any sort of failures in sea transportation, whatsoever the reason. The Company will not take any responsability in package travels  which are performed at the insistence of passengers with no mutual consent about the beginning of transfer and its phases.

PERSONAL DATA AND  PRIVACY POLICY

The Company will not make available to other persons or companies the personal data acquired from passangers (name, surname, address, e-mail and other). The passenger consents that the Company uses his e-mails for sending information and marketing materials. The Company is responsible to remove the passenger’s data from the newsletter list immediately upon the passenger’s request.

COMPLAINTS

In case of complaints about  inadequate or unsatisfactory performance of services the Passanger has to make to the service provider representative an immediate complaint on the spot. The Company is responsible to remedy the shortcomings on the spot, if possible.

If the Company does not manage to remedy the shortcomings, the passenger may send a written complaint to the Company within 8 days of transfer ending. The Company will not take into consideration either the complaints sent after the 8 day deadline, or the complaint that the passanger missed to make immediately on the spot, thus denying the Company the opportunity of remedying immediately the reasons of complaint.

FINAL REGULATIONS

These General Conditions are the basic part of the Contract that the passanger signs with the Company. The said contract will be shown on the Company’s webpage and sent by e-mail by which the Company gives a final confirmation of a service reservation. It is considered that the passangers have accepted these General Conditions at the moment of the beginning of a service performance.

LAW APPLICABLE AND COURT JURISDICTION

The Republic of Croatia law is applied to the contract relations between The Company and the Passanger. In case of dispute, it is the jurisdiction of the court having jurisdiction in Split.

ENTRY INTO FORCE

These General Conditions entry into force on January 1st, 2021.
