OPĆI UVJETI POSLOVANJA

Veseli d.o.o., turistička agencija (u daljnjem tekstu: Tvrtka) specijalizirana je za prijevoz putnika, turističke transfere, organizaciju i provedbu izleta te paket aranžmana trajanja kraćeg od 24 sata koji ne uključuju uslugu smještaja. Tvrtka može posredovati u pružanju drugih turističkih usluga temeljem zasebnih ugovora s pojedinim pružateljima usluga, a takve usluge nisu obuhvaćene ovim Općim uvjetima osim ako nije izričito drugačije navedeno. Tvrtka raspolaže vozilima registriranim za prijevoz do 8 odnosno 4 putnika te posjeduje sve potrebne licence za obavljanje unutarnjeg javnog cestovnog prijevoza i autotaxi prijevoza. U razdobljima povećane potražnje Tvrtka može angažirati partnerske prijevoznike s kojima ima regulirane poslovne odnose.
TURISTIČKI TRANSFERI I PRIJEVOZ PUTNIKA
Prijevoz putnika i turistički transferi obavljaju se temeljem prethodnog dogovora između Tvrtke i putnika kao autotaxi prijevoz ili kao prijevoz za vlastite potrebe. Plaćanje usluga u pravilu se obavlja gotovinom ili kreditnim karticama po izvršenju usluge, a iznimno uplatom na poslovni račun Tvrtke. Tvrtka i putnici dužni su posvetiti posebnu pažnju planiranju transfera prema zračnim lukama kako bi se osigurao dolazak najmanje 2 sata prije planiranog leta. Tvrtka ne snosi odgovornost za kašnjenja nastala zbog prometnih zastoja, vremenskih neprilika, tehničkih kvarova, odluka nadležnih tijela ili drugih okolnosti izvan njezine kontrole niti za kašnjenja realizirana na inzistiranje putnika bez prethodnog usuglašavanja vremena polaska. Za vrijeme trajanja usluge prijevoza svi putnici osigurani su od posljedica nesretnog slučaja sukladno važećim propisima.
IZLETI
Za svaki izlet Tvrtka će na mrežnim stranicama ili drugim komunikacijskim kanalima navesti osnovne informacije o odredištu, cijeni i planu putovanja. Rezervacije izleta vrše se usmenom ili pisanom komunikacijom putem e-maila ili mobilnih aplikacija, a nakon potvrde rezervacije Tvrtka izdaje vaučer ili drugu pisanu potvrdu. Otkazivanje izleta prije početka realizacije moguće je bez naknade osim ako nije drugačije ugovoreno, dok u slučaju otkaza nakon početka realizacije putnici plaćaju 70% ugovorene cijene. U slučaju nepovoljnih vremenskih uvjeta ili drugih okolnosti koje mogu utjecati na sigurnost ili kvalitetu usluge Tvrtka zadržava pravo izmjene plana putovanja uz prethodni dogovor s putnicima. Tvrtka ne odgovara za izgubljenu, oštećenu ili ukradenu prtljagu ili osobne stvari tijekom izleta.
PAKET ARANŽMANI I POVEZANI PUTNI ARANŽMANI
Tvrtka organizira paket aranžmane i povezane putne aranžmane kraće od 24 sata bez noćenja. U slučaju da aranžman uključuje prijevoz morem trajektom, katamaranom ili speedboatom Tvrtka djeluje kao posrednik te ne preuzima odgovornost za izvršenje tog dijela usluge, dok za sigurnost, vrijeme polaska, trajanje prijevoza i prtljagu odgovaraju pružatelji tih usluga. Prijevoz speedboatom ovisi o vremenskim uvjetima te Tvrtka u slučaju nepovoljnih vremenskih prilika može osigurati zamjenski prijevoz uz odgovarajuću prilagodbu cijene. Tvrtka ne odgovara za kašnjenja ili izmjene uzrokovane poremećajima u pomorskom prometu ili višom silom.
OGRANIČENJE ODGOVORNOSTI
Tvrtka ne odgovara za štetu nastalu uslijed više sile, vremenskih nepogoda, prometnih zastoja, tehničkih kvarova, odluka državnih tijela, kašnjenja drugih prijevoznika ili drugih okolnosti izvan njezine razumne kontrole. Ukupna odgovornost Tvrtke, kada postoji, ograničena je na iznos plaćene usluge.
OSOBNI PODACI I ZAŠTITA PRIVATNOSTI
Tvrtka obrađuje osobne podatke putnika sukladno važećim propisima o zaštiti osobnih podataka i Općoj uredbi o zaštiti podataka (GDPR) isključivo u svrhu realizacije ugovorenih usluga i komunikacije s putnicima. Putnik ima pravo zatražiti pristup, ispravak ili brisanje svojih podataka u svakom trenutku.
PRIGOVORI
Putnik je dužan eventualne nedostatke prijaviti bez odgađanja tijekom trajanja usluge kako bi Tvrtka mogla pokušati otkloniti nedostatak. Pisani prigovor može se podnijeti u roku od 8 dana od završetka usluge, a Tvrtka neće razmatrati prigovore podnesene nakon isteka tog roka.
MJERODAVNO PRAVO I NADLEŽNOST
Na ugovorni odnos primjenjuje se pravo Republike Hrvatske, a za sve sporove nadležan je stvarno nadležni sud u Splitu.

Veseli d.o.o., tourist agency (hereinafter: the Company) specializes in passenger transport, tourist transfers, organization and execution of excursions, and package arrangements lasting less than 24 hours and not including accommodation services. The Company may mediate other tourism services based on separate agreements with individual service providers, and such services are not covered by these Terms and Conditions unless explicitly stated otherwise. The Company operates vehicles registered for the transport of up to 8 and 4 passengers and holds all necessary licenses for public road passenger transport and taxi services. During periods of increased demand, the Company may engage partner transport providers with whom it maintains regulated business relationships.
TOURIST TRANSFERS AND PASSENGER TRANSPORT
Passenger transport and tourist transfers are carried out based on prior agreement between the Company and the passenger, either as taxi transport or transport for own needs. Payment is generally made in cash or by credit card upon completion of the service, and exceptionally by bank transfer to the Company’s business account. The Company and passengers are required to pay special attention when planning transfers to airports in order to ensure arrival at least 2 hours before the scheduled flight. The Company shall not be liable for delays caused by traffic congestion, adverse weather conditions, technical failures, decisions of public authorities, or other circumstances beyond its reasonable control, nor for delays resulting from departures requested by passengers without prior mutual agreement on the departure time. During the transport service, all passengers are insured against accidents in accordance with applicable regulations.
EXCURSIONS
For each excursion, the Company shall provide essential information through its website or other communication channels, including destination, price and general itinerary. Reservations are made through written or verbal communication via e-mail or mobile applications, and upon confirmation the Company issues a voucher or other written confirmation. Cancellation of an excursion before its commencement is possible without charge unless otherwise agreed, while cancellation after the start of the excursion requires payment of 70% of the agreed price. In the event of adverse weather conditions or other circumstances affecting safety or service quality, the Company reserves the right to modify the itinerary in agreement with passengers. The Company is not liable for lost, damaged or stolen luggage or personal belongings during excursions.
PACKAGE ARRANGEMENTS AND LINKED TRAVEL ARRANGEMENTS
The Company organizes package arrangements and linked travel arrangements lasting less than 24 hours and not including overnight accommodation. If an arrangement includes sea transport by ferry, catamaran or speedboat, the Company acts solely as an intermediary and assumes no responsibility for the execution of that part of the service; responsibility for safety, departure times, duration of transport and luggage lies with the respective service providers. Speedboat transport depends on weather conditions, and in case of unfavorable weather the Company may provide alternative sea transport with a corresponding price adjustment. The Company shall not be liable for delays or changes caused by disruptions in maritime transport or force majeure.
LIMITATION OF LIABILITY
The Company shall not be liable for damages resulting from force majeure, adverse weather conditions, traffic congestion, technical failures, decisions of public authorities, delays of other transport providers or any other circumstances beyond its reasonable control. Where liability exists, the Company’s total liability shall be limited to the amount paid for the service in question.
PERSONAL DATA AND PRIVACY
The Company processes passengers’ personal data in accordance with applicable data protection regulations and the General Data Protection Regulation (GDPR), solely for the purpose of providing agreed services and communicating with passengers. Passengers have the right to request access to, correction or deletion of their personal data at any time.
COMPLAINTS
Passengers are required to report any deficiencies without delay during the service so that the Company may attempt to remedy the issue. Written complaints may be submitted within 8 days of completion of the service, and the Company shall not consider complaints submitted after this deadline.
GOVERNING LAW AND JURISDICTION
The contractual relationship between the Company and the passenger shall be governed by the laws of the Republic of Croatia, and any disputes shall fall under the jurisdiction of the competent court in Split.
ENTRY INTO FORCE
These Terms and Conditions enter into force on 01 January 2021.
